  1. Opening a User Profile

    1.1 You must be at least 18 years of age in order to open a PaySwyft User Profile and make payments through PaySwyft’s ' services. By accepting these Terms and Conditions you warrant and represent that you are 18 years or older. You accept these Terms and Conditions by checking the appropriate box during the User Profile application process or other instances where we may ask you to accept them. You should print and retain a copy of these Terms and Conditions for your records.
    1.2 You must be a resident of the United Kingdom (UK) (including its territories and possessions) to use our services. If you are a corporationcompany, your place of incorporation as well as your main business office must be established within the United Kingdom. By accepting these Terms and Conditions you warrant and represent that you are a resident of the UK.
    1.3 The information you provide to us when opening a User Profile must be truthful and accurate. Any attempted or actual submission of false information will result in our rejection of your User Profile. It also may be treated by us as attempted or actual fraud and may be reported to the appropriate authorities.
    1.4 The services associated with or provided in connection with the User Profile are provided by Flycke UK Ltd., a company registered in England.[TOP]

  2. Card Payments

    2.1  Your User Profile enables you to store your credit card or debit card account or other payment ("Payment Instrument") information with us for use in payments to participating merchants for bona fide sales or leases of goods or services ("Card Payments Service"). In order to participate in the Card Payments Servicemake a payment, you must enter information regarding a valid Payment Instrument in your User Profile. PaySwyft  will submit your Payment Instrument information to the applicable credit or debit cardpayment network in order to process the transaction on behalf of the participating merchant.
    2.2  By adding a Payment Instrument to your User Profile, you authorize that Payment Instrument to be charged in order to process your Card Payments Servicepayment transactions. You also authorize PaySwyft to debit or credit your Payment Instrument to correct errors or to process refunds or other adjustments related to your Card Payments Servicepayment transactions.
    2.3  PaySwyft has no liability for any goods or services purchased through the Card Payments Serviceusing a Payment Instrument. PaySwyft  is solely a payment service provider and is not a bank. Any proceeds of transactions conducted through the Card Payments Service are not deposits and are not insured by the Federal Deposit Insurance Corporation.[TOP]

  3. Transaction History

    Your User Profile enables you to view your transaction history online. This service is provided to you for your convenience and shall in no way substitute any transaction statement or other information provided to you by the issuer provider of a card Payment Instrument which you use for making payments through the PaySwyft services. If you notice any discrepancy between the entries of the transaction history of your User Profile and the entries in a transaction statement provided by any card issuer Payment Instrument provider, you should contact us and your card issuerPayment Instrument provider to resolve the issue. In order for PaySwyft to undertake an investigation of an alleged error, you must contact PaySwyft within 180 days of the date of the date of the transaction that you believe is in error.[TOP]

  4. Safeguarding your login details

    Your User Profile is protected by a login and password. You must not share your password with anyone. You should not record your login details and password anywhere in writing or otherwise. If you think your login details and/or password may have been lost, stolen, disclosed to any third party or otherwise compromised, you must inform us immediately.
    Your User Profile is protected through a unique login and password.  We recommend that you use a password that comprises a minimum combination of [8 letters, numbers and symbols].
    You should never disclose your login and password to anyone. You should not record your login details and password anywhere in writing or otherwise.  If you think your login details and/or password have been lost, stolen, disclosed to any third party or otherwise compromised, you must inform us immediately.   5. Personal Information

    5.1  You are required to keep the information in your User Profile accurate and up to date. Continued use of your User Profile with inaccurate information may be regarded by us as a breach of these Terms and Conditions and may result in termination of your User Profile.  You agree that we may require you to provide additional information at any time in order to participate in our services. From time to time, we also may obtain information from third parties (including but not limited to credit or identity verification information) to ensure you are authoriszed to use your Payment Instrument, verify that your Payment Instrument account is in good standing or otherwise verify your ability to receive services from PaySwyft in accordance with these Terms and Conditions.
    5.2  We will collect, process and/or disclose your personal information in accordance with our Privacy Policy which forms part of these Terms and Conditions. [TOP]

  6. Making payments through PaySwyft

    You may not use the PaySwyft services to make payments for:
    • Tobacco products;
    • Prescription drugs, pharmaceuticals or pseudo-pharmaceuticals;
    • Drugs and drug paraphernalia;
    • Weapons and , ammunition and knives ;
    • Official, government or police uniforms;
    • Satellite and cable TV descramblers or other devices designed or likely to be used for infringing intellectual property rights or circumventing protective measures against such infringement;
    • Counterfeit products, illegal downloads, files or software or other products infringing intellectual property rights;
    • Embargoed goods or goods from embargoed or otherwise restricted countries or merchants;
    • Adult material of any kind; 
    • Offensive, racially or culturally insensitive materials;
    • Government IDs, licenses, including novelty items;
    • Unlicensed lotteries or gambling services;
    • Multi-level marketing schemes, pyramid schemes, Ponzi schemes, "get rich quick" schemes or similar schemes; and
    • Gambling and gambling services of any kind [TOP]

  7. Change in Terms

    PaySwyft reserves the right in its sole discretion to make changes to, impose limits or conditions on your use of, suspend or terminate any or all of the services provided under these Terms and Conditions, without notice or liability except as required under applicable law. [TOP]

  8. Liability

    8.1  IN NO EVENT WILL PaySwyft, ITS RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR AFFILIATES, BE LIABLE FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR ANY LOSS, THEFT, DISAPPEARANCE, OR DAMAGE TO DATA TRANSMITTED ELECTRONICALLY IN CONNECTION WITH THIS AGREEMENT.
    8.2  WE HEREBY DISCLAIM ANY AND ALL REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, MADE TO YOU OR ANY OTHER PERSON REGARDING QUALITY, SUITABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR OTHERWISE (REGARDLESS OF ANY COURSE OF DEALING, CUSTOM, OR USAGE OF TRADE) OF ANY SERVICES PROVIDED UNDER THESE TERMS AND CONDITIONS OR ANY GOODS PROVIDED INCIDENTAL TO SUCH SERVICES.   9. Closing your User Profile

    9.1  You may at any time request that we close your User Profile. Please be aware that we will keep your personal details and the transaction history on our systems for at least 18 months  or such longer period as required by Card Associations (such as Visa and MasterCard®) or by law.
    9.2  You can open a new User Profile at any time, however, you can only maintain one User Profile at any one time. [TOP]

  10. Communication

    10.2 By accepting these Terms and Conditions, you agree that we may communicate with you regarding PaySwyft services electronically, via either (1) e-mail to the e-mail address and/or SMS message to the mobile phone number provided in your User Profile, or (2) posting on the PaySwyft website or another website address of which we notify you via e-mail or SMS message. We may provide all communications about PaySwyft services to you electronically, such as, but not limited to, agreements, policies, notices or disclosures, or changes to the same; information on your Card Payments; or customer service communications.

    10.3 You agree that we may provide electronic communications in lieu of providing paper communications which may be required under applicable law.  You are responsible for retaining these electronic communications, such as by saving a copy on your computer or printing a paper version. Electronic communications from us will be deemed received by you when sent by us to the e-mail address or mobile phone number provided in your User Profile, posted on the PaySwyft  website or when we provide you with notice of posting on another website. You are responsible for maintaining an up-to-date e-mail address and mobile phone number in your User Profile.


    10.4 In order to receive and retain electronic communications we provide to you, you will need to maintain an active e-mail account with an internet provider. Where possible, you should enable the option to receive e-mails in html-format. Maintenance of these requirements is your responsibility, and you are solely responsible for any fees charged by your internet provider.
    10.5 If you would like to receive a paper copy of any communications we provide to you electronically, you may contact us at the contact information listed above. Please note that we may charge you a fee for notices provided in paper form. If you withdraw your consent to receive communications electronically at any time, we may suspend or terminate the provision of PaySwyft services to you. [TOP]
